The plaintiff is a globally well-known software enterprise registered in Wisconsin, US. The Serv-U FTP software developed by the plaintiff and can effectively solve the document transmission between website users and website hosts or servers. Because of its excellent performance and influence, the software is widely used in various large websites and enterprises. On December 10, 2012, the plaintiff detected through system command that the defendant was using the Serv-U 6.4 software of the plaintiff on its website. Upon inquiry, the defendant did not obtain legal authorization, which constituted pirated use. Then, the plaintiff filed a lawsuit with the People's Court of Siming District of Xiamen City, claiming legal rights according to law.
2. Judgement Result
In the first trial, the defendant's maritime school was ordered to immediately stop infringing, namely, uninstalling Serv-U 6.4 software from its website and server, and compensating the plaintiff for economic losses and reasonable expenses of 50000 yuan.
